Is CBD Legal in the UK?

One of the most common questions we get asked here at CBD NectarNurse is simply this: “Is CBD legal in the UK?”

It’s a fair question. After all, the one thing everyone knows (or thinks they know) about CBD is that it contains extracts from the cannabis plant, and, as of this writing, cannabis is still a controlled substance. People want to know if they are putting themselves at risk if they buy CBD products or if they are stopped by police with CBD on their person.

In this article, we’re going to go over the basics of CBD and its position under the law to help reassure you and allow you to buy with confidence.

Is CBD Legal in the UK?

As of this writing (June 2024), CBD is legal to buy in the UK, so long as certain conditions are met during production. Certain cannabinoids, such as tetrahydrocannabinol (more commonly known as THC), must be limited to less than 1 mg per container, for instance. This is because THC contains the psychoactive ingredient in pure cannabis that gives you a high.

CBD Oil and Edibles

As we discussed in a previous entry in this blog, How to Take Your CBD, one of the most popular ways to take CBD is via ingestion, either as an oil or as an edible. CBD oil is a neutral liquid base with cannabinoid extracts, while edibles are a variety of foodstuffs, such as gummies and cookies, that include CBD as one of their ingredients. As well as ensuring the THC levels in the CBD are within legal parameters, manufacturers of CBD oils and edibles must apply for a Novel Food authorisation. These are issued by the Food Standards Agency (FSA) here in the UK, and they confirm that the product is safe for consumption.

Applying for Novel Food Authorisation

The British government takes food safety very seriously. If a company wants to sell its ingestible CBD products in the UK, it needs to submit a dossier of toxicological data to the FSA for a full review before being allowed to sell. This is a time-consuming and expensive process, often costing more than £50,000 to complete. These strict regulations ensure that any CBD products on the market are safe and legal to consume.

CBD Vapes

When it comes to CBD vapes, whether we’re talking about disposable CBD pens or e-liquids for replenishing a refillable vaping device, the rules are even more complex. In addition to meeting the maximum THC levels, CBD vapes must also fulfil all the regulatory conditions for standard vaping devices, ensuring the purity and safety of the carrier oil and any flavourings.
